On April 29, 2004, John Grasso, Vincenza Grasso, Lina Parrinelli and Placido Parrinelli were passengers aboard Alitalia Airlines flight AZ 1716 from Catania, Italy, to Milan, Italy. They alleged that when they were exiting the aircraft, they fell using the exterior stairs provided by Alitalia and Alitalia Linee Aree Italiane-Societa Per Azioni. They alleged that John Grasso had a nondisplaced fracture of the medial malleolus of the left ankle and that Lina Parrinelli sustained a nondisplaced fracture of the lateral and posterior malleoli of the left ankle.John Grasso, Vincenza Grasso, Lina Parrinelli and Placido Parrinelli sued Alitalia and Alitalia Linee Aree Italiane-Societa Per Azioni on June 13, 2005, in the U.S. District Court for the Southern District of New York.
Plaintiff Teresa Fajardo, 21, a factory worker, was sexually assaulted in a stairwell at her place of business, which was located at 56 Bogart St. in Brooklyn. Her assailant was never identified or apprehended. Fajardo alleged that the Hovivians were negligent for failing to provide adequate security. Settlement: Shortly before the scheduled start of jury selection, the parties agreed to a $400,000 structured settlement.
On March 28, 2002, plaintiff's decedent Evelyn Kalish, 83, and her husband, Daniel, went to New York's Ethel Barrymore Theatre, where they were to attend a play. Kalish tripped while descending the stairway in the theater's left front mezzanine. She fell and sustained blunt-impact injuries. She died approximately seven hours later. Mr. Kalish alleged that the staircase violated the Building Code of the City of New York. Specifically, he claimed the lighting was inadequate, that its riser heights and tread depths varied, and that it lacked handrails. The defendants noted that the theater opened in 1928 and contended that the alleged violations were grandfathered exceptions to the code. Settlement: The parties agreed to a $275,000 settlement, which was paid by Ethel Barrymore Theatre.
